{"id":2780,"date":"2024-06-05T10:49:17","date_gmt":"2024-06-05T10:49:17","guid":{"rendered":"https:\/\/thenewsroomhub.co.ke\/?p=2780"},"modified":"2024-06-05T10:49:17","modified_gmt":"2024-06-05T10:49:17","slug":"babu-owino-and-others-freed-of-charges-related-to-subversive-activities","status":"publish","type":"post","link":"https:\/\/thenewsroomhub.co.ke\/index.php\/2024\/06\/05\/babu-owino-and-others-freed-of-charges-related-to-subversive-activities\/","title":{"rendered":"Babu Owino and Others Freed of Charges Related to Subversive Activities"},"content":{"rendered":"\n<p>Embakasi East MP Babu Owino, also known as Paul Ongili, has been acquitted of charges related to conspiracy to commit chaos or subversive activities. <\/p>\n\n\n\n<p>Babu and self-proclaimed &#8220;ghetto president&#8221; Calvin Gaucho, along with five others, were released.<\/p>\n\n\n\n<p>Milimani Chief Magistrate Lucas Onyina withdrew the case after the Director of Public Prosecutions (DPP), represented by prosecution counsel James Gachoka, expressed their intent to withdraw the charges. <\/p>\n\n\n\n<p>Gachoka informed the court that a High Court judge had nullified section 77(1) of the Constitution, the basis for the charges against the accused.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"774\" src=\"https:\/\/thenewsroomhub.co.ke\/wp-content\/uploads\/2024\/06\/image-1024x774.png\" alt=\"\" class=\"wp-image-2781\" srcset=\"https:\/\/thenewsroomhub.co.ke\/wp-content\/uploads\/2024\/06\/image-1024x774.png 1024w, https:\/\/thenewsroomhub.co.ke\/wp-content\/uploads\/2024\/06\/image-300x227.png 300w, https:\/\/thenewsroomhub.co.ke\/wp-content\/uploads\/2024\/06\/image-768x580.png 768w, https:\/\/thenewsroomhub.co.ke\/wp-content\/uploads\/2024\/06\/image.png 1286w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Gachoka argued that the prosecution could not proceed with the trial since it was based on an unconstitutional provision. <\/p>\n\n\n\n<p>Defence lawyers, led by Danstan Omari and Dancun Okatch, contended that the charges were politically motivated.<\/p>\n\n\n\n<p>Magistrate Onyina granted the DPP&#8217;s application to withdraw the case, citing the unconstitutionality of the section under which the accused were charged, as ruled by the High Court in Nakuru.
